AFZs are areas on public roads, footpaths, laneways and carparks where drinking alcohol is not allowed.

APAs apply to public spaces like parks, reserves, and beaches where alcohol is also banned.

In both types of zones, it is illegal to drink alcohol. NSW Police can enforce these zones and tip out alcohol on the spot.

AFZs and APAs are put in place to:

• Discourage anti-social behaviour in public spaces
• Reduce alcohol-related disturbances and incidents
• Help prevent more serious crime linked to street drinking
• Support safer, more inclusive and family-friendly environments

These zones are one part of Council’s broader approach to community safety, which also includes urban design, events, programs and education.

Council is required by the NSW Department of Local Government Ministerial Guidelines on Alcohol-Free Zones to review AFZs every four years.

AFZs are covered under Sections 642-648 of the Local Government Act 1993. APAs are covered under Section 632A of the Local Government Act.

While APAs don’t have a set review timeframe, Council is reviewing them alongside AFZs to ensure a consistent and up-to-date approach.

The current zones are in place until 21 December 2025. This review helps determine:

• Which existing zones should remain unchanged
• Where boundaries should be adjusted
• Whether new zones should be introduced

Council has:

• Reviewed local crime and incident data
• Considered reports and concerns from the community
• Worked closely with Lake Illawarra Police and other stakeholders
• Assessed the impact of nearby licensed premises
• Asked for feedback from nearby property owners and residents
• Asked other groups for their input, including Aboriginal and Torres Strait Islander groups, Culturally and Linguistically Diverse groups, the Local Health District, and nearby licensed venues.

This helped inform the proposed changes now open for community feedback.

NSW Police enforce these zones. If someone is found drinking alcohol in an AFZ or APA, police may:

• Seize the alcohol
• Tip it out on the spot
• Issue a caution or fine, depending on the situation
